What the guarantee provides
If an application handled under our confirmed trademark service is finally refused despite the client meeting the agreed requirements, we provide one refiling without charging another Infinity Filer processing service fee. This is a service remedy, not a promise that a government agency will register a mark.
Eligibility agreed before filing
The original application must be accepted into our service after scope and eligibility review. You must provide accurate ownership, domicile, goods/services and use information, supply legitimate evidence when required, follow agreed deadlines and instructions, and arrange required licensed representation. The engagement records the mark, classes and work covered.
When the remedy applies
Contact us with the final refusal and application reference. We review the completed file and confirm the appropriate refiling scope in writing. A pending examination, an office action, a delayed response or a voluntary withdrawal is not a final refusal. A new mark, owner or materially expanded scope requires agreement before work proceeds.
Costs you still pay
The client pays all new USPTO application and other official fees, any attorney fees and separate professional work. The guarantee waives our processing fee for one refiling only. It does not refund original official or third-party fees and does not cover additional refilings.
Your account and legal representation
Keep control of your own USPTO account. Our live assistance does not replace a licensed attorney where one is required. U.S. entity formation or a U.S. mailing address alone does not determine domicile. An attorney engagement and any additional cost are confirmed separately.
