Review the actual filing basis, application details and current official fee schedule before treating a starting amount as the final cost for a particular case.

Determine domicile rather than relying on an LLC

Attorney requirements depend on the applicant’s domicile under USPTO rules. Owning a U.S. LLC or using a U.S. mailing address does not by itself establish U.S. domicile. Identify the actual applicant and relevant principal place of business or residence as required. Where a U.S.-licensed attorney is required, confirm eligibility, scope and the attorney’s separate fee before filing.

Understand use and intent-to-use stages

The correct filing basis depends on the facts and supporting evidence. An intent-to-use application can involve later use-related filings and fees after a notice of allowance. A use-based application needs appropriate evidence at the relevant stage. Do not claim use simply to avoid a later cost. The authority’s process and the application’s actual history determine what must be filed next.

Budget for issues outside initial preparation

Office actions, extensions, extra classes and other requirements can add work or official fees. Not every case follows the simplest route. Our initial quote should state what is excluded, and the client is responsible for agreed additional official costs arising during the process. Ask for a breakdown before authorizing extra work rather than assuming a single headline covers every possible event.
